1. The Service

NodeVigil provides monitoring, alerting, and reporting for Ethereum validator performance and related data. The Service may integrate with third-party platforms such as Telegram or Slack.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for ensuring that your use complies with applicable laws.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and current information.

4. Subscriptions

The Service is offered on a subscription basis. Plan limits and features are described on the website and may change over time. Fees are billed in advance and are non-refundable except as expressly stated in these Terms.

5. Guarantee

If the Service misses a listed alert for a validator in a given month, you may be eligible for a refund as described on the pricing page. Guarantee eligibility is limited to the alert types included in your plan and subject to verification.

6. Acceptable Use

You may not misuse the Service, attempt to disrupt its operation, or access it using automated methods not provided by NodeVigil. You agree not to reverse engineer, copy, or resell the Service.

7. Third-Party Services

The Service may rely on third-party APIs and messaging platforms. We are not responsible for outages, delays, or errors caused by those services.

8. Data and Privacy

You retain ownership of your data. By using the Service, you grant NodeVigil permission to process your data to provide the Service. Our privacy practices are described in the Privacy Policy.

9. No Financial Advice

The Service provides informational monitoring and reporting only. It does not constitute financial, legal, or tax advice. You are solely responsible for your validator operations and decisions.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, NodeVigil will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

12. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may cancel your subscription at any time, subject to the billing terms.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
